Agreement to Terms and Conditions (the “Terms”)
1. General Information
The website babilygifts.eu (“the Website”) is owned and operated by Babily Gifts by Ana Arizanovic, an independent trader registered in Luxembourg with registration number A45262, and a registered address at 2, rue Mathieu Lambert Schrobilgen, 2526 Luxembourg, Luxembourg. Our VAT number is LU35968536.
References to “we,” “us,” or “our” mean Babily Gifts by Ana Arizanovic, and “you” or “your” refers to you, the customer.
2. Acceptance of the Terms
By accessing or using the Website and purchasing products from it, you agree to abide by these Terms. If you are under eighteen (18), you may place an order only with the involvement of a parent or guardian.
3. Modifications to the Terms
We reserve the right to change these Terms at any time at our discretion. The version displayed on the Website when you access it will apply to your use. Continuing to use the Website after changes are made constitutes your acceptance of the new Terms.
4. Account and Personal Information
- Account Creation: You may purchase products as a guest or create an account on the Website. You are responsible for maintaining the confidentiality of your account details, including your username and password.
- Data Usage: Your data will be used solely for processing and dispatching purchases and may be shared with payment and courier service providers. We will not share your information with other third parties without consent.

- Access to Orders: A copy of each order is retained by Babily Gifts by Ana and is accessible in your account’s order section. Orders are concluded in English.

6. Prices and Payments
- Currency: All prices are in Euros (€) and exclusive of VAT, in line with article 57§1 of Luxembourg’s VAT law. Prices may be updated due to changes in delivery or material costs and will reflect the current price listed on the Website.
- Payment Methods: Payment options include Google Pay, PayPal, and direct bank transfer. Orders are processed upon receipt of payment, typically within one business day.
- Order Confirmation: Payment in full is required at the time of order confirmation. Failure to pay will result in order suspension or termination.
7. Availability and Order Cancellations
- Product Availability: All orders are subject to availability. In cases of supply difficulties, we reserve the right to cancel orders and refund payments.
- Order Cancellation: Orders may be canceled if delivery is delayed by more than 15 days beyond the expected delivery date. In such cases, please contact Customer Service.
8. Delivery
- Shipping: Free shipping is offered for orders over a certain threshold, which varies by delivery location. If this threshold is not met, delivery fees will be confirmed at checkout. Shipping times are typically 3-5 business days; however, allow extra time during holiday periods.
- International Orders: Additional delivery charges may apply based on your location, and rates will be displayed on the Website.
- Delivery Issues: If you haven’t received your order as indicated in tracking, please first check with neighbors or your carrier. If you still cannot locate it, contact us within 30 days of shipment to initiate a carrier dispute.
9. Returns and Refunds
- Right to Cancel: You may cancel your order within 15 days from the date you receive the goods, provided the items are unused and in their original packaging.
- Return Process: Please contact orders@babilygifts.eu before returning items. The sender is responsible for return postage, which is non-refundable.
- Refunds: We process refunds within 15 days of receiving returned goods, using the same payment method as the original order. No additional fees will apply.
10. Complaints
To file a complaint, please contact us at complaints@babilygifts.eu. If unresolved, you may refer disputes to the EU’s Online Dispute Resolution Platform at https://ec.europa.eu/odr.
11. Force Majeure
We are not liable for delivery disruptions due to unforeseeable events beyond our control (e.g., natural disasters, pandemics). In such cases, delivery times will be extended, or orders may be canceled.
12. Mediation Procedure
Customers may seek conventional mediation or alternative dispute resolution in the event of a dispute.
13. Jurisdiction and Applicable Law
- For Private Customers: The governing law and jurisdiction are based on your residence.
- For Business Entities: The applicable law is Luxembourgish law, with disputes resolved in Luxembourg courts.
